Properly presented applications get granted more often than applications unsupported with substantial evidence. A properly prepared application for disability retirement will make a difference to get the benefit granted. Timing when to file the application is important to get the application granted. If there is delay in filing proving continuous disability with contemporaneous supporting medical evidence will be required. Retirement Systems have a myriad of reasons to deny applications. An application considered untimely will be cancelled or denied. It is important to get the application accepted by CalPERS or a County Retirement System / Association to have it processed. Otherwise, one must overcome hurdles that could have been avoided.
Many do not realize that the retirement systems already have lawyers involved at the inception of the application. Knowing what to include in a properly presented application to get it granted is most important. Analysts and attorneys review the material and make recommendations to the Retirement Boards. At many retirement associations its lawyers are present when the members cases are presented to grant or deny. It is important that the member know their rights and the law if the need to argue the reason to grant the benefit arises.
Understanding the medical evidence and the legal errors doctors make in their reports is important. Many cases turn on whether doctors applied the correct legal standard. The retirement systems take particular interest in selecting its “independent doctors” to evaluate the applicants. There are doctors that we are familiar with that have routinely denied disability causing applicants to litigate their claims. Presenting the best evidence from the beginning and understanding pitfalls is important. Properly Presented applications are granted more often by retirement systems.
